Welcome to UNTU, Inc. (“UNTU”, “Company”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website located at https://untubiz.com (the “Site”), our web and mobile applications, email add-ins, and any related software, SaaS platforms, or services provided by us (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Services.

1. Description of Services

UNTU, Inc. provides usability and new technologies utilization solutions, including but not limited to server management, D-Email SaaS, and SAYMON SaaS. We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice or liability.

2. Eligibility and Account Registration

To access certain features of our Services, you may be required to register for an account. By creating an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security and confidentiality of your login credentials.
  • Promptly notify us at support@untubiz.com if you discover or suspect any unauthorized access or security breaches.
  • Take full responsibility for all activities that occur under your account.

The Services are intended solely for users who are 18 years of age or older, or the age of majority in your jurisdiction.

3. SaaS Subscription and Payment Terms

Certain Services, such as our SaaS platforms, are billed on a subscription basis in accordance with our SaaS Subscription Agreement.

  • Billing: You agree to provide valid billing data and authorize us (or our third-party processors like Chargebee, PayPal, or Stripe) to charge all subscription fees.
  • Cancellations: You may cancel your subscription at any time through your account interface or by contacting support. Cancellations apply to the next billing cycle; payments already processed are non-refundable unless specified otherwise by local laws.
  • Taxes: All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities, which you are responsible for paying.

4. Acceptable Use and Restrictions

You agree not to use the Services to:

  • Violate any applicable local, state, national, or international law or regulation.
  • Infringe upon or violate our intellectual property rights or the rights of others.
  • Upload, transmit, or distribute viruses, malware, or any software intended to damage or alter a computer system or data.
  • Interfere with, disrupt, or create an undue burden on servers or networks connected to the Services.
  • Attempt to gain unauthorized access to the Services, other accounts, or computer systems through hacking, password mining, or any other means.

5. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by UNTU, Inc., its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall UNTU, Inc., its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services.
  • Any conduct or content of any third party on the Services.
  • Any content obtained from the Services.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for any claims under these terms shall not exceed the amount paid by you to UNTU, Inc. for the Services in the twelve (12) months preceding the event giving rise to liability.

7. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the United States and the State where the Company is incorporated, without giving effect to any choice or conflict of law provision. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the applicable courts located in the United States or Singapore.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease.
